Welcome to bookmystay!

These Terms and Conditions (“Terms”) govern your access to and use of the bookmystay website, including any content, functionality, and services offered on or through bookmystay (the “Website”), whether as a guest searching for properties or a host listing properties.

Please read these Terms carefully before you start to use the Website. By using the Website, you accept and agree to be bound and abide by these Terms and our Privacy Policy, found at [Link to Privacy Policy Page]. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Website.

1. Acceptance of Terms

bookmystay provides an online platform that connects hosts who have properties to rent with guests seeking to rent such properties. These Terms constitute a legally binding agreement between you and BookMyStay.uk regarding your use of the Website and Services.

2. Definitions

  • “bookmystay,” “we,” “us,” or “our” refers to the owner and operator of the Website.
  • “User,” “you,” or “your” refers to any individual or entity accessing or using the Website, whether as a Guest or a Host.
  • “Guest” refers to a User who searches for, books, or stays at a property listed on the Website.
  • “Host” refers to a User who creates a listing for a property on the Website. This includes individuals listing their own personal properties and those managing properties on behalf of others.
  • “Listing” refers to a property posted by a Host on the Website for rent.
  • “Booking” refers to the reservation of a Listing by a Guest through the Website.
  • “Services” refers to any and all services provided by bookmystay through the Website.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Website and Services. By using the Website, you represent and warrant that you meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Website.

4. Account Registration and Security

  • To access certain features of the Website, you may be required to register an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify bookmystay immediately of any unauthorized use of your password or account or any other breach of security.
  • bookmystay reserves the right to suspend or terminate your account and refuse any and all current or future use of the Services if you provide any information that is untrue, inaccurate, not current, or incomplete, or if bookmystay has reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete.

5. For Hosts: Listing Your Property

  • Accuracy of Listings: As a Host, you agree to create accurate and complete Listings. You are solely responsible for all content, including photos, descriptions, and pricing, that you post. You must accurately describe your property, its amenities, rules, and any costs associated with it.
  • Availability: You must keep your Listing’s calendar up-to-date and accurately reflect its availability.
  • Compliance with Laws: You represent and warrant that your Listing and the booking of your property will not breach any agreements you have entered into with third parties (such as homeowner’s association rules or rental agreements) and will comply with all applicable laws, rules, and regulations (including but not limited to zoning laws, licensing laws, and laws governing rental properties).
  • Hosting Others’ Properties: If you are listing a property on behalf of another owner, you confirm that you have all necessary rights, permissions, and agreements from the property owner to do so and to manage bookings through bookmystay. You agree to indemnify BookMyStay.uk for any claims arising from your failure to obtain such permissions.
  • Host Fees: bookmystay may charge fees to Hosts for the use of its Services. These fees will be clearly outlined and agreed upon before you confirm your Listing or Booking.

6. For Guests: Booking a Property

  • Booking Confirmation: Once you make a Booking through the Website, you will receive a confirmation email. This email constitutes your acceptance of the Booking, and a binding agreement is formed between you and the Host.
  • Payment: You agree to pay all charges associated with your Booking, including the rental price, any applicable taxes, cleaning fees, and any other fees specified by the Host or bookmystay.
  • Guest Conduct: You agree to treat the property and the Host with respect, adhere to all house rules set by the Host, and leave the property in the condition it was in when you arrived, reasonable wear and tear excepted.
  • Cancellations and Refunds: Cancellation policies are set by individual Hosts and will be clearly stated in each Listing. By confirming a Booking, you agree to the Host’s cancellation policy. bookmystay will facilitate refunds according to the applicable policy, but is not responsible for the actual refund amount beyond what is agreed upon.
  • Guest Service Fees: bookmystay may charge fees to Guests for the use of its Services. These fees will be clearly outlined before you confirm your Booking.

7. Payments and Financial Transactions

  • bookmystay uses third-party payment processors to facilitate payments between Guests and Hosts. By using the Website, you agree to be bound by the terms and conditions of these third-party payment processors.
  • bookmystay is not a bank or a money services business. All payments are facilitated through our third-party payment partners.
  • You acknowledge and agree that bookmystay is not responsible for any issues arising from payment processing, including but not limited to delays, errors, or security breaches, caused by third-party payment processors.

8. Cancellations and Disputes

  • Host Cancellations: If a Host cancels a confirmed Booking, bookmystay will generally provide the Guest with a full refund of the amounts paid for that Booking and may, at its discretion, offer alternative Listings or assistance in finding new accommodation.
  • Disputes: Any disputes between a Guest and a Host regarding a Listing or Booking should first be attempted to be resolved directly between the parties. bookmystay may, at its sole discretion, offer mediation or assistance in resolving disputes, but is under no obligation to do so and is not responsible for the outcome of such disputes.

9. User Content

  • You are solely responsible for all content that you upload, post, publish, or transmit on the Website, including but not limited to Listing descriptions, photos, and reviews (“User Content”).
  • You grant bookmystay a non-exclusive, worldwide, royalty-free, irrevocable, perpetual, sub-licensable, and transferable license to access, use, store, copy, modify, prepare derivative works of, distribute, publish, and otherwise exploit your User Content to provide and promote the Website and Services.
  • You agree not to post any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

10. Prohibited Uses

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to use the Website:

  • bookmystay IS NOT RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE WEBSITE OR SERVICES.
  • YOU ACKNOWLEDGE AND AGREE THAT bookmystay DOES NOT HAVE CONTROL OVER AND DOES NOT GUARANTEE (I) THE EXISTENCE, QUALITY, SAFETY, SUITABILITY, OR LEGALITY OF ANY LISTINGS OR SERVICES, (II) THE TRUTH OR ACCURACY OF ANY LISTING DESCRIPTIONS, REVIEWS, OR OTHER USER CONTENT, OR (III) THE PERFORMANCE OR CONDUCT OF ANY HOST OR GUEST.

13. Limitation of Liability

IN NO EVENT WILL bookmystay, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

15. Governing Law and Jurisdiction

All matters relating to the Website and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of England and Wales without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the courts of London, United Kingdom, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
